Prenuptial (Premarital) Agreements

It may be uncomfortable to think about the end of a marriage when you’re about to say, “I do.” But when you are making a commitment that may result in legal and financial obligations, discussing that possibility with the other person is precisely what you should do.

Mediation, while not a substitute for solid legal guidance, provides an opportunity for couples who are planning to live together or marry to discuss their concerns openly and to collaborate on finding solutions to the issues that they care about. The outcome will be a stronger relationship, mutually satisfying agreements and less anxiety. If the worst does happen, you will be spared unnecessary expense and heartache at a time of intense emotions.

Discussion points may include:
  • Managing finances
  • Financial obligations from a prior marriage
  • Treatment of premarital assets and debts
  • Treatment of assets and debts acquired during the marriage
  • Spousal support/maintenance
  • Estate planning for children from prior marriages
  • Consideration of nonmonetary contributions to marriage (e.g., one party staying home to care for children or elderly parents)
  • Family gifts & inheritances
  • Tax filing status (joint or married, filing single)
  • Business ownership
